Please read these Terms & Conditions ("Terms") carefully before purchasing any equipment from TyphonMachines.shop. These Terms govern your purchase of heavy machinery and constitute a binding legal agreement between you ("Customer" or "Buyer") and TyphonMachines.shop.


1. General Agreement and Acceptance of Terms

By accessing or using any part of the site, including purchasing products, you agree to be bound by these Terms and Conditions. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

  • Binding Contract: Your placement of an order constitutes an offer to purchase the product, which is subject to acceptance by TyphonMachines.shop. The sales contract becomes binding upon our formal acceptance and shipment confirmation.

  • Business Use: All products sold are intended for commercial, industrial, or professional use and not for personal, family, or household purposes.


2. Product Information and Condition

TyphonMachines.shop sells authentic and original Typhon mini-excavators as a certified reseller.

  • Authenticity Guarantee: We guarantee that all Typhon equipment is 100% authentic and original and is covered by the manufacturer's warranty.

  • Product Specifications: While we strive for accuracy, all product dimensions, weights (e.g., 4,000 lbs), engine specifications (e.g., Kubota D902 HP), and performance statistics are provided by the manufacturer and are subject to minor variations. You acknowledge that final product appearance and technical data may vary slightly from website descriptions.

  • Product Condition: All machines are sold as new and unused, unless explicitly stated otherwise.


3. Pricing and Payment Terms

  • Final Price: The price of the equipment will be the price in effect at the time the order is accepted. All prices are subject to change without notice.

  • Taxes: Prices do not include any federal, state, or local taxes, duties, or levies that may apply to the sale. These charges are the sole responsibility of the Buyer.

  • Payment Security: We accept standard payment methods and require full payment or pre-approved financing confirmation before the equipment is released for shipment. We reserve the right to cancel any order if payment authorization fails or security flags are raised.


4. Shipping, Delivery, and Risk of Loss

  • Free Heavy-Haul Delivery: We offer Free Shipping on All Mini-Excavator Models across the USA. This covers standard freight costs to a commercially accessible address.

  • Customer Responsibility: The Customer is responsible for providing accurate delivery information and ensuring the delivery location can accept heavy freight (including necessary unloading equipment, if required).

  • Inspection upon Arrival: RISK OF LOSS PASSES TO THE BUYER UPON DELIVERY. You, or your authorized agent, MUST inspect the equipment immediately upon arrival. Any external damage, missing components, or discrepancies must be noted immediately on the shipping carrier's Bill of Lading (BOL) before signing. Failure to note visible damage on the BOL may result in the denial of freight damage claims.

  • Delivery Timelines: Delivery estimates are approximate. TyphonMachines.shop is not liable for delays caused by freight carriers, weather, or force majeure events.


5. Manufacturer Warranty and Limitation of Liability

  • Warranty Reliance: TYPHONMACHINES.SHOP EXPRESSLY DISCLAIMS ALL WARRANTIES, whether express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. YOUR SOLE WARRANTY IS THE MANUFACTURER’S WARRANTY provided by Typhon.

  • Limitation of Liability: TyphonMachines.shop shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising out of or related to the sale or use of the products, including lost profits, loss of use, or cost of replacement equipment. Our liability is expressly limited to the purchase price of the product sold.


6. Return and Exchange Policy (30-Day Commercial)

  • 30-Day Window: We offer a 30-day return window from the date of delivery. This policy is subject to strict commercial conditions due to the nature and value of the equipment.

  • Return Conditions: Equipment must be returned in unused, original condition and must include all components, manuals, and accessories. Equipment used on a job site or damaged after acceptance will not be eligible for return.

  • Restocking Fee: All approved commercial returns are subject to a standard restocking fee (details available in our full Return Policy) plus the cost of return freight.


7. Governing Law and Dispute Resolution

  • Governing Law: These Terms and any sale of products shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law principles.

  • Venue: Any legal action or proceeding arising out of or relating to these Terms must be instituted exclusively in the federal or state courts located in Miami-Dade County, Florida.
